These Terms and Conditions of Sale ("Terms") govern the purchase of products ("Products") from Fico Design ("Company," "we," "us") through our website ficodesign.com ("Website") between the Company and the customer ("Customer," "you"). By placing an order, you agree to be bound by these Terms and Conditions.

1. GENERAL PROVISIONS AND CHANGES TO TERMS

  • 1.1 These Terms constitute the entire agreement between the Customer and the Company regarding the purchase of Products through the Website.
  • 1.2 The Company reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Website. Your continued use of the Website following the posting of changes constitutes your acceptance of such changes.
  • 1.2 Each purchase is subject to the version of the Terms in effect at the time the order is placed.

2. ORDERING AND CONTRACT FORMATION

  • 2.1To place an order, you must select the desired Products, add them to your shopping cart, and complete the checkout process.
  • 2.2 By confirming your order, you agree to these Terms, which form a binding contract ("Contract") between you and us.
  • 2.2 Before completing your order, please review all details carefully. You may correct any data entry errors using the modification functions available on the Website. If you notice a mistake after placing your order, please notify us within six hours at info@ficodesign.com to request corrections. We encourage you to report any errors as soon as they are discovered. If corrections are requested beyond the six-hour window, we cannot guarantee that your order will be processed or delivered. In such cases, your order may be canceled, and we will notify you via email while issuing a full refund.
  • 2.2 All orders are subject to written acceptance by the Company, confirmed by an Order Confirmation email sent to the email address provided by the Customer.
  • 2.2 Upon payment for Ready-to-Ship Products, you will receive an Order Confirmation that contains the order number and details, including the price of the Product(s), shipping costs, and the address to which the Product(s) will be shipped. Once payment clears and the Product is ready for shipment, you will receive a Shipping Email with an invoice and either delivery scheduling or tracking information.
  • 2.2 You should retain the order number from the Order Confirmation for all future communications with the Company.

3. PRODUCT SELECTION AND REPRESENTATION

  • 3.1 Products available for purchase include
    • 3.1.1 Ready-to-Ship Products: Products immediately available for purchase on the Website. The estimated timeline of Delivery 13-18 weeks
    • 3.1.2 Made-to-Order Products: This means products that are not readily available, made-to-order products with an estimated delivery timeline of 16-32 weeks.
  • 3.2 Product descriptions, including images and colors, are provided for informational purposes only and may not accurately represent the actual Products due to variations in display settings and the handcrafted nature of the products. For detailed information, contact info@ficodesign.com.
  • 3.4 The Company reserves the right to modify or discontinue Products and prices without notice.
  • 3.5 Products are not intended for testing purposes. You are responsible for your Product selection.

4. PAYMENTS, BILLING, CANCELLATION AND REFUNDS

  • 4.1 Accepted payment methods include credit cards (Visa, Mastercard, American Express, Maestro) and PayPal.
  • 4.2 Payment is required at the time of order or as specified in the Made to Order Product email. The Company reserves the right to cancel orders if payment is not authorized.
  • 4.3 Customers may cancel orders within 3 days for a full refund. Cancellations made after 3 days are subject to a 100% cancellation fee. The Company reserves the right to cancel orders and issue full refunds in the event of unforeseen circumstances beyond its control.
  • 4.4 Refunds will be issued via the original payment method.

5. SHIPPING AND DELIVERY

  • 5.1 Products are delivered to the address provided by the Customer via Company-appointed couriers or Official Retailers. Ready-to-ship products are shipped via ground transportation.
  • 5.2 Shipping charges are displayed at checkout. Delivery times are estimates and not guaranteed. The Company is not liable for delivery delays. If a Ready-to-Ship product is not shipped within 30 days of full payment, the Customer may cancel and receive a full refund.
  • 5.3 Estimated ship dates are provided in the Shipping Email. Made-to-order products have longer delivery times.
  • 5.4 Assembly services are not provided unless specified.
  • 5.5 Partial deliveries are permitted and do not entitle the Customer to refuse delivery or compensation.
  • 5.6 Upon delivery, the Customer must verify the contents and condition of the package.

6. FAILURE TO ACCEPT DELIVERY

  • 6.1 The courier will schedule delivery with the Customer. An authorized representative (18 years or older) must be present for delivery.
  • 6.2 If delivery fails due to the Customer, additional charges may apply.
  • 6.3 If the Customer fails to accept delivery within 60 days, the Company may terminate the Contract, retain payments, and dispose of the Products. The Customer is responsible for storage fees and any resale deficiency.

7. RETURN OF PRODUCTS

  • 7.1 Made-to-order products are not returnable.
  • 7.2 Customers must notify the Company of their intent to return a Product within the applicable return window by emailing info@ficodesign.com with the order details and reason for return.
  • 7.3 The Customer must return the Products within 14 days of notifying the Company.
  • 7.4 Refunds for returned Products will be issued within 14 days of receipt, provided the Products are undamaged and meet return conditions. The Customer is responsible for return shipping costs. Damaged returns will not be refunded.

8. PRODUCT WARRANTY

  • 8.1 Products are sold with a 1-year limited warranty against material defects. The Company disclaims all other warranties, express or implied.
  • 8.2 The warranty does not cover damages from wear and tear, misuse, accidents, improper maintenance, or force majeure.
  • 8.3 The Company is not responsible for transport damages that are not reported to the courier at the time of delivery.
  • 8.4 To make a warranty claim, email info@ficodesign.com for instructions. The Company will repair, replace, or refund defective Products at its discretion.

9. LIMITATION OF LIABILITY

  • 9.1 The Company is not liable for indirect, incidental, or consequential damages.
  • 9.2 The Company’s liability is limited to the total amount paid by the Customer for the Products.
  • 9.3 This limitation does not affect consumer rights under applicable laws.

10. PRIVACY POLICY

  • 10.1 The Company’s Privacy Policy governs the collection and use of Customer information.
